2. ShtFly's Response:
Upon receiving a valid DMCA notice, ShtFly will take the following actions:
- a. Promptly investigate the reported infringement.
- b. Remove or disable access to the infringing material identified in the notice.
- c. Notify the user responsible for posting the infringing material, providing them with a copy of the DMCA notice and the opportunity to submit a counter-notice.
3. Counter-Notification:
If you receive a DMCA notice and believe that the material in question has been mistakenly identified or removed, you may submit a counter-notification to ShtFly's Copyright Agent. Your counter-notification should include:
- a. Identification of the material that has been removed or disabled, including the URL(s) where it was located before removal.
- b. Your contact information, including your name, address, telephone number, and email address.
- c. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- d. A statement that you consent to the jurisdiction of the federal court in your jurisdiction and that you will accept service of process from the person who submitted the original DMCA notice.
- e. Your physical or electronic signature.
Please send the counter-notification to the same Copyright Agent listed in Section 1 above.
4. Repeat Infringers:
ShtFly reserves the right to terminate the accounts of users who are found to be repeat infringers of copyright.
